These Terms of Service ("Terms") constitute a legally binding agreement between you and NotYourAvgMedia LLC ("we," "us," or "our"), a Tennessee limited liability company operating at notyouravgmedia.com. By accessing our website, booking our services, or engaging with us in any capacity, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
NotYourAvgMedia LLC provides professional real estate media production services, including but not limited to:
Service availability, pricing, and packages are subject to change without notice. Current pricing is displayed on our booking page at the time of purchase.
Booking Process: All bookings are made through our online booking system at notyouravgmedia.com/booking. A booking is confirmed only after successful payment processing.
Payment: Full payment is required at the time of booking. All payments are processed securely through Helcim, our PCI-DSS compliant payment provider. Prices are listed in U.S. dollars.
Travel Fees: Properties located outside our standard service area may be subject to a travel fee, calculated at the time of booking based on the property's zip code.
After booking, we will contact you within 24 hours to confirm the exact shoot time. You are responsible for:
More than 48 hours before the shoot: You may cancel or reschedule at no charge. Full refund will be issued for cancellations.
Within 48 hours of the shoot: Cancellations are subject to a $150 rebooking fee. Rescheduling within 48 hours is accommodated when possible but may be subject to the same fee.
No-shows: If you fail to provide access to the property at the scheduled time without prior notice, the booking fee is non-refundable.
Weather: In the event of inclement weather that would compromise the quality of exterior or drone work, we will reschedule at no additional cost.
Standard turnaround for completed media is 24-72 hours after the shoot, depending on the scope of the project. Rush delivery may be available upon request. Completed media will be delivered electronically via download link sent to the email address provided at booking.
All work produced by NotYourAvgMedia is backed by our NotYourAvg Guarantee. If any deliverable does not accurately represent your listing or meet the agreed-upon scope, we will provide revisions at no additional charge. Revision requests must be submitted within 14 days of delivery. This guarantee covers technical quality and scope accuracy — it does not cover subjective creative preferences beyond what was agreed upon before the shoot.
License to Client: Upon full payment, you receive a non-exclusive, perpetual license to use all delivered media for the purpose of marketing, advertising, and selling the specific property photographed/filmed. This includes use on MLS listings, social media, websites, print materials, and other marketing channels.
Retained Rights: NotYourAvgMedia LLC retains copyright ownership of all media produced. We reserve the right to use delivered media in our portfolio, website, social media, marketing materials, and for promotional purposes unless you request otherwise in writing before the shoot.
Restrictions: You may not resell, sublicense, or distribute the raw media files to third parties for purposes other than marketing the specific property. Use of media to represent a different property than the one photographed is prohibited.
All aerial drone operations are conducted by FAA Part 107 certified remote pilots in compliance with federal, state, and local regulations. Drone flights may be restricted or unavailable due to:
If drone services cannot be performed for any of these reasons, that portion of the booking will be refunded or rescheduled.
To the maximum extent permitted by law, NotYourAvgMedia LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services, including but not limited to lost profits, lost sales, or business interruption. Our total liability for any claim related to our services shall not exceed the amount paid for the specific booking in question.
You agree to indemnify and hold harmless NotYourAvgMedia LLC, its owners, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of our services, your breach of these Terms, or your violation of any applicable law.

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Cumberland County, Tennessee.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of our website and services after any changes constitutes acceptance of the revised Terms.
